If necessary, judge could force Apple to “Fortnite” in the US app store

After Apple “Fortnite” still does not let the American App Store and Epic Games had lodged a complaint in court, the responsible judge has now reported an order. She asks why Apple does not succeed in fulfilling her arrangement. The iPhone group is “completely able to solve the matter without further briefing or hearing”.

Epic Games had submitted a version of “Fortnite” with a said integrated web payment about his daughter Epic Games Sweden in the app review. This was not left through because Apple initially wants to wait for a decision by the responsible court in which the group had filed a complaint against the order of Gonzalez Rogers. According to the judge, Apple has no participations to web buyers of apps-but that’s exactly why Apple removed “Fortnite” from the App Store years ago and filed Epic Games. Now Apple should enable web purchases in the USA without any hint-also warnings as they are still displayed in the EU, are no longer explicitly allowed. Providers such as Spotify or Amazon Kindle have already reacted and redesigned their apps accordingly – Apple let them through.

In the case of Epic Games, Apple is graceful: The group argues, among other things, that Epic Games no valid developer account for the USA has more. The company therefore uses Epic Games Sweden. Since the web payment was installed in the app submitted there, its non-approval ensured that all other versions of “Fortnite” were initially blocked-also those for alternative App Marketplaces such as the Epic Games Store for iOS. Apple announced Epic Games that the company could submit the app without the web payment intended for the USA.

In her order, Gonzalez Rogers has now asked Apple to implement the approval of “Fortnite”. However, if both parties do not report enforcement, the “personally responsible” Apple-Official-probably app-store boss Phil Schiller or service manager Eddy CUE-have to stop by the judge on May 27, an appointment is already scheduled at 9 a.m. in Oakland, California.

The arrangement is considered unusual because it affects such high managers directly. Now the question arises how Apple and his lawyers react. To add the dispute, “Fortnite” could be accepted-but that would then contradict the app store rules. It is still unclear when Apple’s objection to Gonzalez Rogers’ decision will be negotiated.
