Dispute with EU: Apple makes alternative proposals to the DMA

As part of its response to the current DMA procedure of the EU Commission, Apple has made several proposals to be improved, such as the digital law, from which the group feels harassed. If the Digital Markets Act is not withdrawn in order to “replace) it for a” legislative instrument) that fits for its purposes “should be at least deep changes, the group writes.

Apple calls for the creation of an independent European authority that acts outside the European Commission so that it can be “protected from political interference” to “ensure a predictable, fair, balanced and the legal text of the DMA that pays attention to fundamental rights”. The new DMA authority should involve the relevant EU authorities from the areas of data protection and cyber security when it comes to instructions that affect the “fundamental rights to privacy and online security of users”.

After all, Apple is bothered by the concept of the so -called “effective compliance” and calls for clarification. According to its own statements, the company is faced with constantly changing statements and claims from the EU Commission that are difficult to implement. Apple also hopes for a review of “overarching proportionality”. The European Commission should expressly oblige this to take into account the interests of end users when it comes to security, data protection, integrity and innovation. “In addition, it should recognize the importance of the fundamental rights of gatekeers, such as rights to intellectual property and the right to operate their business, including through product differentiation.”

Meanwhile, the EU Commission officially rejected Apple’s demand to stop or at least change the DMA. Spokesman Thomas Regnier, responsible for digital matters, said according to one Report by France24Apple finally “questioned every small part of the DMA since the beginning”.

One is therefore “not surprised” by the demands. Regnier said it was the only thing Brüssels to “decide how we want to enforce the DMA and who enforced the DMA”. Most recently, Apple had received a penalty of 500 million euros for DMA violations against which the company is doing.
